ACCEPTANCE OF TERMS:

Your use of a site made by Elle's Web Design constitutes your agreement to these Terms of Service, which may be updated by us from time to time without notice to you. 

Description of services:
Elle's Web Design currently provides its customers with original web design and graphics, along with free items to supplement the site ("Services"). Unless explicitly stated otherwise, you shall be subject to this Terms Of Service agreement. You understand and agree that the Services are provided "AS IS" and that Elle's Web Design assumes no responsibility for the timeliness, deletion, or failure to store any user communications or personalization settings before, during, or after the site is uploaded.

Small Business Web Site Creation:

• Description Of Service
  Elle's Web Design designs and builds small, HTML-driven web sites for small businesses, organizations or individuals by using the materials and information submitted to Elle's Web Design through email or postal mail.  Elle's Web Design does not provide hosting services, design and development above and beyond what is outlined in these Terms Of Service, or consulting services other than those outlined in these Terms of Service.
• Materials Submission
  Each Customer is responsible for submitting all materials necessary for the design and creation of their web site. This information may be submitted either by email or by postal mail to :

• All materials are subject to Elle's Web Design policy regarding acceptable content.   Materials which contain adult or hate content, which compete directly or indirectly with Elle's Web Design, or which infringe on another party's trademarks or copyrights, will not be considered acceptable content.
• Web Site Creation
  Once Elle's Web Design has received all materials and payment from the Customer, in acceptable form, Elle's Web Design will create the Customer's web site within seven (7) business days of such receipt using the text and graphics submitted as well as text and graphics created by Elle's Web Design.
• Web Site Review Period
  Once a Customer's web site has been built Elle's Web Design will notify the Customer by email at the email address provided by the Customer that their site is available for review. The Customer will have up to three (3) business days to review the site online and either approve it or submit changes to Elle's Web Design. These changes can be emailed to elleswebdesign@hotmail.com. If the Customer does not respond within three (3) business days of receiving the email notification that their site has been built, their site will be deemed accepted. 
• Changes
  Elle's Web Design will make acceptable changes properly submitted by the Customer during the three (3) business day review period. Acceptable changes to the web site include correction of misspellings, colors or fonts requested by the Customer but not used, or obvious and material errors in logos or images, such as the use of logos or images submitted by a different Customer. Acceptable changes do not include changes in text or graphics other than those listed as acceptable changes, major or minor web site redesign, introduction of additional text and graphics after site is complete, or additional pages and services not included in the original package. Elle's Web Design will make acceptable changes within seven (7) business days of receiving requests. After the acceptable changes have been completed, the Customer will be notified by email within three (3) business days that the changes have been made.
• Final Completion
  After the acceptable changes have been completed, or the period of three (3) business days with which to request acceptable changes has passed, whichever comes first, the creation and design of the web site will be deemed final.
• Additional Changes
  The Customer may, at any time after their web site is complete, request changes to their web site. Each change will be subject to the fees set forth in this agreement. A change ("Change") is defined as modifications to the text on one page, modifications to a particular image or logo, deletion or addition of text or an image on one page, or other minor changes deemed acceptable to Elle's Web Design. Changes do not include major site redesign or reconstruction or the addition of pages to the web site.
• Additional Web Pages
  The Customer may, at any time, request additional pages ("Pages") to their web site. Additional pages will be subject to the fees set forth in this agreement.
• Refusal Of Service
  Elle's Web Design reserves the right to refuse service for any reason and at any time. Web sites that contain adult or hate content, compete directly or indirectly with Elle's Web Design, or infringe on another party's rights or freedoms, will be refused automatically. If service is refused, fees will be refunded by either: (a) mailing back the check to the Customer, or (b) crediting the Customer's credit card account in the amount that it was charged. If service is refused, Elle's Web Design will attempt, but is not required, to provide the reason for refusal.
• Fees
  All fees are non-refundable once the Customer's request for a custom-built web site by Elle's Web Design is received and accepted by Elle's Web Design. All fees set forth in this agreement are subject to change at any time and without notice to the Customer. The Customer agrees that additional, third-party fees may apply to the Customer's web site, including, but not limited to, domain name registration and hosting services. The fee for a six-page, custom-built professional web site is $75.00. The fee for any Changes is $10.00 per Page. The fee for any additional Pages is $20 per additional Page.
  

DISCLAIMER OF WARRANTIES:
You agree that your use of our Services is solely at your own risk. 
We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the Services will meet your requirements, or that the Service(s) will be uninterrupted, timely, secure, or error free; nor do we make any warranty as to the results that may be obtained from the use of the Service(s) or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service will be corrected.  We make no warranty regarding any goods or services purchased or obtained through the Service or any transactions entered into through the Service.  No advice or information, whether oral or written, obtained by you from us or through the Service shall create any warranty not expressly made herein.

LICENSE YOU GRANT TO ELLE'S WEB DESIGN:
Elle's Web Design does not claim ownership of the materials you provide to Elle's Web Design (including feedback and suggestions) or post, upload, input or submit in connection with your use of Elle's Web Design or any web site created by Elle's Web Design on your behalf (collectively "Submissions"). However, you grant Elle's Web Design a royalty-free license to use (including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, sublicense and reformat your Submission), and to publish your name in connection with your Submission only in connection with the operation and promotion of Elle's Web Design. You also grant Elle's Web Design the right to publish your name in connection with any such communication. No compensation will be paid or due you with respect to Elle's Web Design's use of the materials as licensed above. Elle's Web Design is under no obligation to post or use any materials you may provide, and may remove such materials from the Elle's Web Design web site at any time at Elle's Web Design's sole discretion. By requesting a Small Business Web Site from Elle's Web Design, Customer warrants and represent that you own or otherwise control the rights necessary to do so and to grant Elle's Web Design the license set forth above, and you will defend and indemnify Elle's Web Design and its suppliers from any third party claim related to a breach of any of the foregoing representations or warranties.

AGE AND RESPONSIBILITY
You represent that you are of sufficient legal age to use this site any services provided herein and to create binding legal obligations for any liability you may incur as a result of the use of this site or the services of Elle's Web Design. You understand that you are financially responsible for all uses of this site by you.

ACCEPTANCE OF AGREEMENT:

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF THE SERVICE AND ARE NOT RELYING ON ANY REPRESENTATION AGREEMENT, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
